These Terms of Service (the “Terms”) are a binding agreement between you and MyCallDesk (“MyCallDesk”, “we”, “us”, “our”) and govern your use of the MyCallDesk website, dashboard, AI receptionist, phone numbers, messaging and related services (the “Service”). By creating an account, starting a free trial, or using the Service, you accept these Terms on behalf of yourself and the business you represent (“you” or “Customer”). If you do not agree, do not use the Service.
01The Service
MyCallDesk is an AI front desk for service businesses. Depending on your plan, the Service can answer and route phone calls, hold natural-language conversations with callers and texters, capture and qualify leads, book jobs, schedule and dispatch work to your team, send text messages and email notifications, and produce call recordings, transcripts, summaries and recommended actions.
We continuously improve the Service. We may add, change or remove features, but we will not materially reduce the core functionality of a paid plan during a billing period you have already paid for.
02Accounts, team members & eligibility
You must be at least 18 years old and authorized to bind the business you register. You agree to provide accurate information and keep it current. The person who creates the account is the account Owner. Owners and Admins can invite team members (for example, technicians), assign roles, and remove access at any time.
You are responsible for everything that happens under your account, including the actions of your team members, and for keeping passwords confidential. Tell us immediately at support@mycalldesk.net or info@mycalldesk-mail.net if you suspect unauthorized access.
03Free trial
New accounts may start with a free trial. Unless we state otherwise at sign-up, the trial lasts 14 days or 30 handled calls, whichever comes first, does not require a payment card, and may use a temporary MyCallDesk phone number. When the trial ends, AI call handling pauses until you choose a paid plan. We may limit, change or end trial offers at any time and may refuse trials that appear abusive or duplicate.
04Plans, billing & usage
- Subscription. Paid plans are billed monthly in advance in U.S. dollars and renew automatically until cancelled. Current plans, included call minutes and features are shown on our Pricing page and in your dashboard.
- Usage above your plan. Call minutes above your plan’s monthly allowance are charged at your plan’s per-minute overage rate and added to your next invoice. Minutes are measured from the time a call is answered to the time it ends, rounded up to the next minute.
- Payments. Payments are processed by Stripe. By subscribing, you authorize us (through Stripe) to charge your payment method for subscription fees, overage and applicable taxes. We never see or store your full card number.
- Plan changes. Upgrades take effect immediately and are prorated. Downgrades take effect as described in your Billing & Subscription page; features or allowances above the new plan may no longer be available.
- Taxes. Prices exclude sales, GST/HST/PST, VAT and similar taxes, which are added where required.
- Failed payments. If a payment fails, we may retry the charge, notify you, and suspend the Service after reasonable notice until the balance is paid.
- Price changes. We will give you at least 30 days’ notice of a price increase. It takes effect at your next renewal after the notice period; you can cancel before then.
Cancellations and refunds are covered by our Refund & Cancellation Policy.
05Phone numbers
We provision phone numbers through our telecommunications partners. While your account is active and paid, the number is assigned to you for use with the Service. Numbers are subject to carrier rules and availability. If your account is cancelled or closed for non-payment, we may release the number back to the carrier after 30 days. If you want to keep a number, ask us before cancelling and we will reasonably assist with porting it to another provider where the carrier allows.
If you forward your existing business number to MyCallDesk, you remain responsible for that number and your arrangements with its carrier.
06The AI agent & your responsibilities
Your AI agent speaks and writes based on the business information, services, hours, rules and instructions you provide. You are responsible for that information being accurate and lawful, and for reviewing the agent’s behaviour, including greetings, quoted prices, booking rules and anything it tells callers on your behalf.
AI can misunderstand speech, make mistakes, or produce inaccurate summaries. Leads, jobs and recommendations created by the Service are aids to your team, not guarantees. You should confirm important details with customers before relying on them.
07Call recording, transcription & consent
The Service records, transcribes and analyses calls and messages so it can deliver summaries, leads and jobs. Laws in some provinces and states require that every party to a call be told it is being recorded or handled by an automated system, or consent to it.
You are responsible for configuring an appropriate disclosure (for example, in your greeting) and for obtaining any consent the law requires from your callers and customers. We provide settings to help you, but compliance is your responsibility.
08Text messaging & calling laws
When the Service sends texts or places calls on your behalf, you are the sender. You agree to comply with all applicable laws and carrier requirements, including Canada’s Anti-Spam Legislation (CASL) and CRTC Unsolicited Telecommunications Rules, the U.S. Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and carrier registration rules such as A2P 10DLC and toll-free verification.
You may only message people who have contacted you or otherwise given the required consent, and you must honour opt-out requests. The Service processes STOP/START keywords automatically. See our SMS Terms for details.
09Acceptable use
You agree to follow our Acceptable Use Policy, which forms part of these Terms. In short: no illegal, deceptive, harassing or spam communications, no robocalling or cold-call campaigns, and no attempts to abuse, overload or break into the Service.
10Your content & data
You own the information you provide and the content the Service generates for you, including business details, customer and lead records, jobs, recordings, transcripts, messages and summaries (“Your Content”). You grant us a limited licence to host, copy, process, transmit and display Your Content only as needed to provide, secure and support the Service, and to improve it in a way that does not identify you or your customers.
We do not sell Your Content, and we do not use it to train general-purpose AI models offered to others. Our handling of personal information is described in our Privacy Policy. You confirm you have the rights and consents needed for us to process Your Content, including your customers’ personal information.
You can export key records from the dashboard while your account is active. After cancellation we keep Your Content for up to 30 days so you can reactivate or request an export, then delete or anonymize it in line with our Privacy Policy, except where we must keep it to meet legal obligations.
11Third-party services
The Service relies on third-party providers such as telecommunications carriers, AI model providers, payment processing, email delivery and cloud hosting. We list our main providers on our Subprocessors page. Integrations you choose to connect are governed by those providers’ terms, and we are not responsible for services we do not control.
12Availability & support
We work to keep the Service available around the clock, but it may occasionally be unavailable because of maintenance, upgrades, carrier or provider outages, or events outside our reasonable control. We will try to give advance notice of planned maintenance. Support is available by email at support@mycalldesk.net or info@mycalldesk-mail.net and through the Help Center.
13Our intellectual property & feedback
The Service, including its software, design, AI prompts, workflows, logos and documentation, is owned by MyCallDesk and its licensors and is protected by law. We grant you a non-exclusive, non-transferable right to use the Service during your subscription in line with these Terms. You may not copy, resell, reverse-engineer or build a competing product from the Service. If you send us suggestions or feedback, we may use them without obligation to you.
14Confidentiality
Each party will protect the other’s non-public information with reasonable care and use it only to perform under these Terms, except where disclosure is required by law.
15Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available”. We disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, that every call will be answered or transcribed correctly, or that it will produce any particular number of leads, jobs or revenue.
16Limitation of liability
To the fullest extent permitted by law, neither party will be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, business opportunities or data, even if advised of the possibility. Our total liability for all claims relating to the Service is limited to the amounts you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
17Indemnification
You will defend and indemnify MyCallDesk against third-party claims, fines and costs arising from Your Content, your communications with your customers (including consent, recording and messaging-law claims), or your breach of these Terms or the Acceptable Use Policy.
18Suspension & termination
You may cancel at any time from Billing & Subscription. We may suspend or terminate the Service if you materially breach these Terms and do not fix the breach after notice, if payment is overdue, or immediately if needed to prevent fraud, abuse, legal violations or harm to the Service, carriers or others. Sections that by their nature should survive termination will survive.
19Governing law & disputes
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without regard to conflict-of-law rules. The courts located in Vancouver, British Columbia have exclusive jurisdiction, unless the law where you are located gives you the right to bring a claim elsewhere. Before starting any formal proceeding, please contact us so we can try to resolve the issue informally.
20Changes to these Terms
We may update these Terms from time to time. For material changes we will give at least 30 days’ notice by email or in the dashboard before they take effect. Continuing to use the Service after that date means you accept the updated Terms.
21General
These Terms, together with the policies they reference, are the entire agreement between you and us about the Service. If any part is held unenforceable, the rest remains in effect. Failing to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
